Denne platform formidler biltransporter i hele Europa mellem registrerede kunder og godkendte transportører. En bindende transportanmodning kan først oprettes efter registrering, login og udtrykkelig accept af kundevilkårene og privatlivspolitikken. Uden disse samtykker er brug af kundeområdet til ordreoprettelse ikke tilladt.

Transportørvilkår
Transportøren er alene ansvarlig for licenser, forsikringer, chauffører, underleverandører, lastsikring, ruteplanlægning, vejafgifter, toldoverholdelse, tilstands-dokumentation og overholdelse af alle gældende transport-, skatte- og arbejdsretlige regler. Omgåelse af systemet, proforma-bud eller misbrug af frigivne data kan føre til øjeblikkelig blokering og retslige skridt.
Hvis transportører frivilligt aktiverer deling af placering i dashboardet eller i transportørens kortvisning, kan browseren behandle enhedens aktuelle placering, så transportørens egen position kan vises på kortet, og orienteringen mod åbne opgaver bliver lettere. Denne deling af placering er frivillig, kan til enhver tid tilbagekaldes i browserens eller enhedens indstillinger og bruges kun til kortvisning, orientering og funktioner inden for platformen.

Databeskyttelse
Operatøren behandler personoplysninger til registrering, autentifikation, rollefordeling, godkendelse af transportører, håndtering af anmodninger og bud, rute- og prisberegning, betalingsbehandling, fakturering, e-mailkommunikation, forebyggelse af misbrug, revisionslogning, systemsikkerhed og opfyldelse af lovbestemte opbevaringsforpligtelser. Afhængigt af brugen kan der behandles kontodata, kontaktdata, køretøjs- og rutedata, transportørdokumenter, anmeldelser, betalingsreferencer og tekniske logs.
Kortpositioner gives kun til grov orientering før frigivelse af de præcise kundedata. På trods af tekniske plausibilitetskontroller påtager vi os intet ansvar for, at afhentnings- eller leveringssteder vises fuldstændigt korrekt, komplet eller målfast på kortet.
Hvis transportører aktivt giver samtykke til deling af placering i dashboardet, kan browseren levere enhedens aktuelle placering, så kortet kan vise, hvor transportøren befinder sig. Supplerende vilkår om formidling, ansvar, betaling og regres
Følgende bestemmelser regulerer LogiCar Transports formidlerstatus, ansvar, betaling og regres.
1. Role of LogiCar Transport
LogiCar Transport is a digital platform for mediating vehicle transport requests between customers and independent carriers.
LogiCar Transport only provides the technical infrastructure through which customers can submit transport requests, carriers can submit offers and the parties can contact each other.
LogiCar Transport is expressly not a carrier, freight forwarder, haulier, transport company or provider of its own transport services.
LogiCar Transport does not perform, organise, direct, supervise or guarantee any specific transport. The platform serves exclusively for technical mediation and processing between the participating users.
2. Contracting parties to the transport
The transport contract is concluded exclusively and directly between the customer and the carrier selected by the customer.
LogiCar Transport does not become a party to that transport contract. LogiCar Transport does not take custody of the vehicle and does not owe pickup, loading, carriage, delivery, delivery time or freedom from damage.
Claims under the transport contract, in particular for loss, damage, delay, non-performance, defective performance or other disruptions, exist exclusively between customer and carrier.
3. Independence of carriers
Carriers act on the platform as independent entrepreneurs in their own name and for their own account.
The carrier is solely responsible for valid licences, permits, business authorisations, sufficient insurance cover, drivers, vehicles, equipment, operational safety, load securing, traffic safety, national and international transport regulations, CMR consignment notes, handover protocols, other transport documents, tax obligations, proper invoicing, performance, deadlines, damage handling and communication with the customer.
The carrier undertakes to offer and perform only such services for which it is legally, professionally, technically and insurance-wise authorised and capable.
4. Customer obligations
The customer must provide all information required for the transport completely, correctly and in good time.
This includes in particular information on vehicle type, make, model and condition, roadworthiness and traffic safety, registration, licence plates, insurance and documents, pickup location, destination and contact persons, access options, opening hours and local specifics, desired dates and deadlines as well as special risks or requirements.
Damage, delays, additional costs, failed trips or other disadvantages resulting from wrong, missing, incomplete or late information from the customer are not borne by LogiCar Transport.
5. No transport guarantee
LogiCar Transport does not guarantee that an offer will be submitted for a request or that a transport will be concluded.
LogiCar Transport also does not guarantee a specific price, delivery time, transport type, suitability of a specific carrier, legality of a specific transport, actual performance by the carrier or economic success for users.
All offers are made by independent carriers. The decision for or against an offer is made solely by the customer.
6. No assignment and no self-entry
LogiCar Transport does not assign carriers with binding effect and does not make an independent transport decision.
The platform may technically structure, display, compare, translate, sort or prepare requests for communication. This does not mean that LogiCar Transport assumes any transport service or enters into the transport contract itself.
Automated functions, suggestions, notifications, filters, price comparisons or technical evaluations also do not constitute an assumption of transport by LogiCar Transport.
7. Payment through Stripe / Stripe Connect
Payments are processed through the payment service provider Stripe or Stripe Connect.
LogiCar Transport is not a payment service provider and does not sell the transport service in its own name.
The transport fee concerns exclusively the relationship between customer and carrier. The platform commission concerns exclusively the use of the mediation platform and must be considered separately from the transport service.
Where payments are technically split, withheld or allocated via Stripe Connect, this serves exclusively technical payment processing and settlement of the platform commission.
8. Separation of transport invoice and commission invoice
The transport invoice and the commission invoice are separate processes.
The invoice for the transport service is attributable to the relationship between carrier and customer.
The invoice for the platform commission is attributable to the relationship between LogiCar Transport and the user liable for commission.
LogiCar Transport does not issue its own invoice for the transport service unless LogiCar Transport expressly and separately acts as invoice issuer for its own service.
9. Chargebacks, cancellations and payment disputes
Chargebacks, payment disputes, reversals, cancellations, non-performance or other payment problems in connection with the transport service generally concern the relationship between customer and carrier.
LogiCar Transport may provide technical information, enable communication or make payment data available for clarification. LogiCar Transport does not make a substantive decision on transport claims, damages, repayment obligations or insurance issues.
10. Liability for transport damage and service disruptions
LogiCar Transport is not liable for loss, damage, reduction in value, delayed pickup, delayed delivery, storage costs, loss of use, lost profit, contractual penalties, consequential damage or other claims arising from performance or non-performance of a transport.
Responsibility for actual performance of the transport lies exclusively with the respective carrier.
Responsibility for complete and correct transport data lies with the respective customer.
11. Liability for platform services
LogiCar Transport is liable only for its own breaches of duty arising from operation of the platform.
In case of simple negligence, LogiCar Transport is liable only for breach of essential contractual obligations and limited to foreseeable damage typical for the contract.
Liability for indirect damage, lost profit, missed orders, production downtime, reputational damage or other consequential damage is excluded to the extent permitted by law.
Liability for intent, gross negligence, injury to life, body or health and mandatory statutory liability remains unaffected.
12. Indemnification against third-party claims
Users indemnify LogiCar Transport against all third-party claims arising from their own conduct, information, offers, transport services, breaches of duty or legal violations.
This includes in particular claims due to wrong or incomplete information, missing licences or permits, missing or insufficient insurance, transport damage, payment default or chargebacks, tax or invoicing errors, data protection violations, unlawful content, fraud, misuse, identity deception and violations of transport, traffic, customs or sanctions regulations.
The indemnification also includes reasonable costs of legal defence.
13. Review and blocking of users and content
LogiCar Transport is entitled to request evidence of identity, company status, insurance, licence, VAT identification, solvency and authorisation.
In case of suspected fraud, misuse, fake companies, unlawful content, missing evidence, expired documents, security risks or other breaches of duty, LogiCar Transport may temporarily or permanently restrict, block or remove accounts, requests, bids, content or functions.
There is no entitlement to permanent use of the platform.
14. Reporting procedure
Users and third parties may submit notices to LogiCar Transport regarding unlawful content, fraudulent users, missing transport authorisations, identity deception, trademark infringements, data protection violations or other breaches of duty.
LogiCar Transport reviews such notices under an appropriate procedure and may take suitable measures, in particular remove content, block requests, restrict user accounts or request further evidence.
15. Insurance and evidence
Carriers must maintain the insurance cover required for their activity during use of the platform.
This includes in particular insurance required for the specific transport type, transport area, vehicle and value of the transported goods.
LogiCar Transport may request insurance evidence, but checking its existence does not constitute a guarantee towards the customer.
Responsibility for sufficient insurance cover remains entirely with the carrier.
16. International transports
For international transports, the participating users are themselves responsible for complying with all applicable national and international regulations.
This concerns in particular transport law, customs law, tax law, sanctions regulations, insurance law, registration law, documentation obligations and cross-border evidence obligations.
LogiCar Transport does not guarantee that a specific international transport is legally permissible or practically feasible.
17. No legal, tax or insurance advice
Information on the platform serves exclusively technical support and orientation.
LogiCar Transport does not provide legal advice, tax advice, insurance advice or professional transport advice.
Users are themselves obliged to independently verify the legal, tax, insurance-related and practical requirements of their respective transport.
18. Platform availability
LogiCar Transport endeavours to operate the platform reliably.
Permanent availability is not guaranteed.
Maintenance, technical disruptions, security measures, external service providers, payment service providers, server providers, network outages or force majeure may lead to restrictions.
LogiCar Transport is not liable for damage arising from temporary unavailability of the platform unless mandatory statutory liability applies.
19. External service providers
LogiCar Transport may use external service providers to provide technical functions, in particular payment service providers, hosting providers, email service providers, map and routing services, security services or analysis tools.
The respective contractual and usage terms of external service providers apply to their services, availability, terms and decisions.
LogiCar Transport is not liable for independent decisions or disruptions of external service providers to the extent permitted by law.
20. Order of priority and interpretation
These provisions clarify the distribution of roles between LogiCar Transport, customers and carriers.
If individual provisions are invalid or unenforceable, the validity of the remaining provisions remains unaffected.
An invalid provision is replaced by the legally permissible provision that comes closest to the economic purpose of the original provision.
Mandatory statutory rights remain unaffected.
